If you are using the PortPro embedded email feature with Gmail or our Google Sheets and Drive integration and have chosen to connect your Google account, we will collect data from this service to enhance your email experience and improve your productivity when using the PortPro application. This includes accessing your Google user data within the PortPro application, allowing you to view and use this data in the relevant context of the TMS software application and initiate relevant business processes based on Gmail and/or Google Sheets and Drive content.

If you use our App(s), in addition to the information listed above, we also collect the following information:

We use Sensitive Personal Information as necessary for certain business purposes, including providing goods or Services as requested; ensuring safety, security; and integrity; countering wrongful or unlawful actions; short term transient use such as displaying first party, non-personalized advertising; performing Services for our business, including maintaining and servicing accounts, providing customer service, processing or fulfilling orders and transactions, verifying customer information, processing payments, providing financing, providing analytic services, providing storage, or providing similar Services on behalf of our business; activities relating to quality and safety control or product improvement; and other collection and processing that is not for the purpose of inferring characteristics about an individual.

Verification process

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system in order to process your know, access, correction, deletion, or appeal requests. We reserve the right to confirm your residency. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g. phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate. If you maintain a password-protected account with us, we may verify your identity through our existing authentication practices for your account and require you to reauthenticate yourself before disclosing or deleting your personal information. If you make a request to delete, we may ask you to confirm your request before we delete your personal information.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. If, however, we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity, and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

You may enable an authorized agent to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. Depending on the kind of request you have made, we may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your privacy rights on your behalf, the information we request to verify your identity, or confirmation that you have given the authorized agent permission to submit the request.

Data processing outside Europe

We are a U.S.-headquartered business and many of our service providers, advisers, partners or other recipients of data are also based in the U.S. This means that, if you use the Service, your personal information will be accessed and processed in the U.S. It may also be provided to recipients in other countries outside Europe.

It is important to note that that the U.S. is not the subject of an “adequacy decision” under the GDPR – basically, this means that the U.S. legal regime is not considered by relevant European bodies to provide an adequate level of protection for personal information, which is equivalent to that provided by relevant European laws.
